Terms of Service

These Terms of Service ("Terms") govern your use of Saarthee Fleet Manager("Service"), operated by NAS Neeraj ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Nature of the Service

Saarthee Fleet Manager is rides management software only. We are not a transportation network company (TNC), rideshare platform, insurer, travel agency, or Turo partner. We do not dispatch drivers, arrange rides, process passenger payments, or guarantee regulatory compliance on your behalf.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts. You represent that you will use the Service only for lawful fleet operations in jurisdictions where you hold required licenses, permits, and insurance.

3. Your Account

Authentication is provided through Clerk. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Operator Responsibilities

You are solely responsible for:

  • Obtaining and maintaining all licenses, permits, and registrations required for private chauffeur services and vehicle hosting (including Turo) in your jurisdiction
  • Maintaining adequate commercial auto liability insurance and any other coverage required by law or platform terms
  • Compliance with state and local regulations (e.g., TCP permits, sales tax collection in Wisconsin and other states)
  • Accuracy of quotes, pricing, receipts, and financial records you create or share with clients
  • Guest safety, vehicle condition, and conduct of your operations

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or in violation of third-party platform terms (Uber, Lyft, Turo, etc.)
  • Attempt to access other users' data, reverse engineer the platform, or resell the Service without permission
  • Upload malicious content or interfere with Service availability
  • Misrepresent the Service as a licensed transportation provider

6. Data and Content

You retain ownership of operational data you enter (rides, expenses, vehicles, bookings). You grant us a limited license to store, process, and display that data to provide the Service. See our Privacy Policy for details on data handling.

7. Third-Party Services

The Service integrates with third parties including Clerk (auth), Neon (database), Vercel (hosting), and Vercel Blob (file storage). Turo calendar sync uses iCal feeds you provide; we are not affiliated with Turo. Your use of third-party services is subject to their respective terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, error-free, or secure operation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

We disclaim liability for transport incidents, accidents, regulatory violations, tax penalties, platform suspensions, or financial losses arising from your operations.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your fleet operations, or your violation of these Terms.

11. Suspension and Termination

We may suspend or terminate your account for violation of these Terms, abuse, or legal requirement. You may stop using the Service at any time. Upon termination, you may request export of your data subject to our Privacy Policy.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles. Disputes shall be resolved in courts located in Wisconsin, unless otherwise required by applicable law.
